Terms of Service

1. Acceptance of Terms

By using AurelianOS ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to both contractors ("Clients") who subscribe to AurelianOS and to customers ("End Users") who receive SMS messages through the platform.

2. Description of Service

AurelianOS provides SMS-based customer communication tools for contractors and local service businesses, including:

• Missed call recovery and SMS triage
• Appointment scheduling via text
• Post-service review request delivery
• Review monitoring and response management

3. SMS Program Terms

The following terms apply specifically to SMS communications sent through AurelianOS:

• Program name: AurelianOS Contractor SMS Service
• Message types: Service request updates, appointment scheduling, and post-service follow-up messages sent on behalf of your contractor.
• Consent requirement: SMS messages are only sent after an end user replies YES to an opt-in request. Consent is obtained prior to any service-related messaging.
• Consent is not a condition of purchase. You may receive services from your contractor without opting in to SMS.
• Message frequency: Up to 6 messages per service engagement, depending on the nature of the request.
• Message and data rates may apply. Standard carrier rates apply to all SMS messages received.
• To opt out: Reply STOP at any time. You will receive a single confirmation message and no further messages will be sent.
• To get help: Reply HELP or contact support@aurelianos.com.
• Carrier liability: Carriers (AT&T, Verizon, T-Mobile, etc.) are not liable for delayed or undelivered messages.

4. Client Obligations (Contractors)

Contractors using AurelianOS agree to:

• Only use the platform to contact customers who have called or otherwise initiated contact with their business
• Not use AurelianOS to send unsolicited or marketing messages unrelated to an active service request
• Ensure their use of AurelianOS complies with applicable federal and state laws, including the TCPA and CAN-SPAM Act
• Maintain accurate business information in their AurelianOS account

5. Prohibited Uses

You may not use AurelianOS to:

• Send spam, unsolicited messages, or cold outreach
• Harass, threaten, or deceive end users
• Violate any applicable law or regulation
• Impersonate another business or individual

AurelianOS reserves the right to suspend or terminate accounts that violate these terms.

6. Data and Privacy

Use of the Service is also governed by our Privacy Policy. By using AurelianOS, you agree to the collection and use of information as described there.

7. Intellectual Property

AurelianOS and its associated software, branding, and content are owned by AurelianOS LLC. Clients are granted a limited, non-exclusive license to use the platform for its intended purpose. No rights are transferred by these terms.

8. Disclaimers and Limitation of Liability

The Service is provided "as is." AurelianOS makes no guarantees regarding uptime, delivery rates, or review outcomes. To the maximum extent permitted by law, AurelianOS LLC shall not be liable for indirect, incidental, or consequential damages arising from use of the Service.

9. Changes to These Terms

We may update these terms from time to time. The "last updated" date reflects the most recent version. Continued use of the Service constitutes acceptance.

10. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions.
